Beta Testing Agreement

Please
completely read these Terms & Conditions and make sure
you agree with them.If you cannot read them or you don't
understand them, please do not sign up for the beta tester
program without contacting me at backer@ziplinq.com.
TERMS
AND CONDITIONS
By signing up to be a Beta Tester, you
signify that you have read, understand agree to the following
General terms: You agree and understand this is not a Final
released version of the cable or adapter and that this product
is a Beta test version for the purpose of testing and possibly
inherent with design anomalies. You agree that there is
NO formal support for this product and none will be available
for free Beta samples. You can not return or exchange Beta
samples for any reason. There is no guarantee of a specific
release date or time for ant Beta product.
As
a Beta Tester, you signify that you have read, understand
agree to the following Legal Terms:
This is an agreement, effective today, between Cables Unlimited
/ ZIP-LINQ (the “Company”) and YOU (the “Tester”),
in which Tester agrees to test a cable or adapter known
as ZIP-LINQ and report to the Company the test results.
1.Company’s
Obligations:
The Company shall provide Tester with a cable / adapter
and any necessary documentation.shall respond to Testers
questions and problems via electronic mail only.
2.Testers’s
Obligations:
a)shall test the cable/adapter under normally expected operating
conditions in Tester’s environment during the test
period.
b)shall gather and report test data to the Company via email
to: backer@ziplinq.com
c)It is expected that the tester will provide the data within
1 weeks or recieving test product.
d)Company maintains the rights to grant or dismiss access
to the beta program at any time during the course of the
program.
e)conclusion of the beta testing, the Company preserves
the rights to publish the Testers feedback in any publication
that it deems appropriate, without compensating Tester,
and will execute reasonable judgment not to harm the reputation
of the Tester.
3.Disclaimer
of Warranty:
Tester understands and acknowledges that the cable/adapter
is a test product and its accuracy and reliability are not
guaranteed. Owing to its experimental nature, Tester is
advised not to rely exclusively on the cable/adapter for
any reason. Tester waives any all claims it may have against
the Company arising out of the performance or nonperformance
the cable/adapter. Further, Tester assumes all responsibility
for damages, lost data, lost profits and other consequences
that result from use of the cable/adapter. |
